Terms of sale

The Valko service is sold by VALKO, sole proprietor (entrepreneur individuel, EI), Sens (89100), France, hereafter “VALKO”.

Valko is a lead follow-up CRM, hosted and available online. It is used to receive leads, organize their follow-up and keep track of the work of the team.

The service is reserved for professionals. It is not offered to consumers.

The free trial lasts 14 days from the first lead received. It requires no bank card.

At the end of the trial, without a subscription, access to the app stops. Leads keep arriving and stay safe.

• €89 excluding tax per month, for up to 3 users;
• €19 excluding tax per month for each additional user.

The subscription is paid monthly, in advance, by card or direct debit, through a payment link. Any late payment automatically incurs penalties of three times the French legal interest rate and a fixed €40 recovery fee.

The subscription has no minimum term. The customer may cancel it at any time by writing to services@valko.fr. Cancellation takes effect at the end of the paid month.

For 30 days after the end of the subscription, the customer can obtain an export of their leads by writing to services@valko.fr. After that period, their leads are deleted. Backup copies are not erased instantly.

VALKO uses reasonable means to keep the service accessible. This is an obligation of means: no availability rate is guaranteed.

VALKO’s liability is limited, for all damages combined, to the sums paid by the customer in the 12 months before the event in question.

• their calls and their compliance with the rules on telephone canvassing, notably those of the French consumer code;
• the legal basis of the leads they process.

These terms are governed by French law. As the service is reserved for professionals, recourse to a consumer mediator is not required.

This section is the data processing agreement. It applies to the personal data the customer entrusts to Valko. The customer is the controller; VALKO is its processor.

• Subject and purpose: providing the service, that is, receiving and keeping leads, organizing their follow-up and alerting the team. VALKO does not process this data for its own needs.
• Duration: the term of the contract, then until the deletion set out for the end of the subscription.
• Data and data subjects: the names, contact details, form answers and sales follow-up of prospects; the names, email addresses and security records of members of the team.
• Instructions: VALKO processes this data on the documented instructions of the customer, that is, these terms, the settings of the service and their written requests.
• Confidentiality: the people authorized to access the data are bound to confidentiality.
• Security: VALKO applies the measures described in the privacy policy, notably access limited by role and group.
• Assistance: VALKO helps the customer, as far as possible, to answer requests from data subjects and to meet their own obligations on security, notification and impact assessment.
• Data breach: VALKO notifies the customer, without delay after becoming aware of it, of any personal data breach that concerns them.
• End of the contract: VALKO deletes the data or returns it to the customer, as the customer chooses, under the conditions set out for the end of the subscription.
• Audit: VALKO provides the information needed to demonstrate that these obligations are met and allows a reasonable audit, requested in writing and prepared together.

Sub-processors: the customer authorizes VALKO to use the following providers. VALKO tells the customer before adding or replacing one, and the customer may object.

• Hostinger: technical hosting and email. The server is located in France and its backups in Lithuania, according to the information provided by Hostinger;
• Meta: Facebook forms, connection of Pages and related imports;
• Google (Gmail): a second inbox, for contact requests sent to VALKO;
• geo.api.gouv.fr: looking up a town from its name and postal code;
• OpenStreetMap: map tiles, requested directly by the browser;
• the Web Push provider of the browser: notifications a user chooses to turn on;
• GitHub: keeping an encrypted backup.

Some of these services apply their own terms and do not process their data exclusively in the European Union.
